Terms & Conditions

These terms and conditions outline important information about becoming a Lash.nomic client and subscriber. Please be sure to read this document mindfully before you join and if you have any questions please ask us prior to agreeing to these terms.

The terms of this agreement nullify anything that you may have been told by anyone. If you have been told anything different from what is contained in this document then you should discuss this with us before agreeing to these terms. The terms and conditions of our studios and website may change from time to time and you will always be able to see the most up-to-date terms and conditions here.

Interpretation and Definitions

 

1. Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

 

Definitions

For the purposes of this Privacy Policy:

    • Account means a unique account created for You to access our Service or parts of our Service.
    • Client means people who have booked and paid to consume our services
    • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to .nomic Limited, 1 U Lam Terrace,Sheung Wan, Hong Kong.
    • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
    • Country refers to: Hong Kong SAR China
    • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
    • Personal Data is any information that relates to an identified or identifiable individual.
    • Service refers to the Website.
    • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analysing how the Service is used.
    • Studios means locations which we operate in.
    • Session (Sessions) means the booking reserved for our lash extension service which we provide for our clients. 
    • Subscriptions means a form of package of lash extensions services where customers pay for multiple sessions or unlimited sessions over the period which they have paid for. 
    • Subscribers mean people who are paying for subscriptions.
    • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
    • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
    • Website refers to Lash.nomic, accessible from lashnomic.com
    • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.




      2. Payment and Transactions

    • All Transactions are final and are processed in Hong Kong Dollars ($ HKD).
    • Upon successful payment processing, you will receive a confirmation of your payment. If your payment is unsuccessful, you must contact your credit card provider for details. Payment in full must be received before bookings and/or orders will be further processed. 
    • Online payments will be processed using Stripe Payment Gateway and your credit card number will be protected with a high level of encryption.

    • Our Terms & Conditions are subject to change at any time. Each transaction shall be subject to the specific Terms & Conditions that were in place at the time of the transaction.

      Bookings and Cancellations

    • Please arrive no later than 15 minutes after your scheduled appointment time. Your booking will be automatically cancelled if you arrive 15 minutes after your scheduled appointment time. You will not receive a refund. If you are on a package, you will forfeit the session. If you are on a subscription, there will be a late/no-show fee of $200.
    • Cancellations and/or rescheduling must be done at least 12 hours prior to the session’s start time. If the cancellation and/or rescheduling notice is received in less than 12 hours from the start time, single purchase customers will be charged 100%. If you are on a package, you will forfeit the session. If you are on a subscription, there will be a late/no-show fee of $200.
    • We reserve the right to close and suspend our services at our studio if there are adverse weather conditions as listed in our Weather Policy or due to any reasons at our discretion.
 
3. Subscriptions
 

  • When you purchase a subscription or service from us you agree to all the terms and conditions of this agreement. 
  • You agree that the information contained in this agreement outlines a complete agreement between you and us. 
  •  If any part of this agreement becomes invalid or discontinued you agree that the remaining parts will continue to be valid.
  •  If .nomic Limited does not enforce its rights under this agreement that does not mean that we are waiving those rights. Our rights under this agreement may still be enforced. 

 

  1. Auto-pay monthly subscriptions (such as the “NAME OF SUBSCRIPTIONS”) 

4.1.. General auto-pay Subscription Terms

  • When you enter into an auto-pay monthly unlimited agreement with us your recurring payments will be secured at the said rate for a period of 12 months. Please be sure to understand that certain promotional subscriptions or purchases may alter this period.
  • We reserve the right to increase your auto-pay amount after the 12-month period and will notify you with one month’s written notice if this is the case.
  • We reserve the right to charge reasonable administration fees for clients whose payments fail on a regular basis. 
  • We reserve the right to terminate auto-pay subscriptions for clients who fail to respond to correspondence from us regarding failed payments. 

4.3..  Auto-pay Subscription suspensions 

  • You are able to suspend your Subscriptions for up to 3 months / 90 days for all 12-month auto-pay commitments. Please be sure to understand that certain promotional Subscriptions or purchases may differ and or suspension periods may not apply. 
  • A minimum of 1 week’s written notice must be given either in the studio or via email to the studio.
  • Please also note that suspending your account will change the date that money is deducted from your bank account/credit card. 
  • It is your responsibility to ensure that your Subscription details are accurate and up to date including all contact details and your nominated bank or credit card details for payments.

4.4..  Auto-pay Subscription terminations 

  • A minimum of 1 week’s written notice must be given either in the studio or via email.
  • Should you find that you are unable to continue your subscription due to illness or injury we will terminate your subscription with immediate effect with a valid medical note. 
  1. Medical or Physical Conditions

It is your responsibility to let us know if you have any medical or physical conditions that may affect you. If you have any medical or physical conditions that will affect you from safely getting lash extensions, it is your responsibility to ensure that you have permission from your doctor or treating practitioner to participate in our sessions. 


By agreeing to these terms you accept that you have no detrimental medical or physical conditions that you are not aware of that may prevent you from participating in our services.


You accept that we are not medical practitioners and cannot give you any advice on your medical condition and your ability to participate in our services.


Physical conditions that may prevent you from participation includes, but is not limited to:

  • Sensitive Skin
  • Allergies  
  1. Release
  • You agree that we will not be liable for any personal items that are damaged, lost, or stolen. 
  • You agree that you will be liable for costs of repairs and replacement of equipment, facilities and furniture damaged by yourself to any of our equipment, facilities and furniture. 

  1. Violation of rules and regulations
  • It is our right to change or vary the above terms and conditions and our policies from time to time. 
  • Any violation of our terms gives us the right to terminate your subscription or service effective immediately at our discretion. We reserve the right to refuse entry to anyone into the studio for any reason including those who have active subscriptions. 
  • We reserve the right to cancel, terminate or suspend subscriptions or access to the studio to any person who breaches the above terms and conditions without warning or notice.

 

  1. Use of studio facilities 
  • We reserve the right to close the studio for periods of refurbishment or holiday periods. If we decide to close the studio for more than 14 consecutive days you may request an extension on your Subscriptions without penalty.
  • Subscription fees will not be reduced if we decide to close the studio for periods of refurbishment or holidays for up to 5 days. 
  1. Discounts and Promotions
  • Unless stated, discounts and promotions cannot be combined and only 1 offer is applicable per payment 
  • We reserve the right to exclude certain offers from discounts and promotions 
  • Discount and promotional offers can be amended and withdrawn by .nomic Ltd. without notice
  • In case of any dispute, we reserve the right of final decision 
  1. Intellectual Property 
  • Our name ‘.nomic Limited’ , our brand ‘lash.nomic’ and any other related marks, logos and service names as shown on the website are our trademarks and hence cannot be used in connection with any product or service unrelated to us without our written consent. 
  • We reserve the rights to all content on our website including but not limited to logos, domain names, trademarks, designs, images, written text which are our belongings or have been legally licensed to us. 
  • Any third party has no right to copy and distribute any of the content that is on our website in any form including but not limited to derivative works. 
  1. Weather Policy

When Typhoon Signal No.8 (or above) or Black Rainstorm Signal is in force by the Hong Kong Observatory, the below studio opening/closing policy will be enforced. 

  • Lash.nomic studios will remain closed if Typhoon Signal No. 8 (or above) or Black Rainstorm Signal is hoisted before studio opening hours and will re-open within 2 hours of the signal being lowered. 
  • Lash.nomic studios will be closed immediately upon hoisting of Typhoon Signal No.8 (or above) during studio opening hours and will remain open if Black Rainstorm Signal is hoisted during studio opening hours. 
  • Stay updated through our Instagram Page : @lash.nomic with the studios opening/closing hours during severe weather conditions.
